The Complete UK Landlord Compliance Checklist for 2026

Keeping up with landlord legislation in the UK is a full-time job. Whether you let one property or ten, missing a single obligation can mean fines, prosecution, or the inability to evict tenants.

Here's every compliance obligation you need to know about as a private landlord in England or Wales.

Single-let vs HMO: If you let to a single household (a couple, a family, or a single tenant), most of the "ALL rental properties" and "England-specific" sections below apply to you. If you let to multiple households (3+ tenants from 2+ households), you likely have additional HMO obligations — see section 12 and our HMO licence guide for the extra requirements.

Obligations for ALL rental properties

1. Energy Performance Certificate (EPC)

  • What: Valid EPC rated E or above
  • When: Before marketing or letting
  • Renewal: Every 10 years
  • Penalty: Up to £5,000

2. Legionella Risk Assessment

  • What: Assessment of legionella risks in the water system
  • When: Before each new tenancy and periodically reviewed (every 2 years recommended)
  • Penalty: HSE enforcement action — unlimited fines and up to 2 years' imprisonment

3. Gas Safety Certificate (if gas supply)

  • What: Annual gas safety check by Gas Safe engineer
  • When: Every 12 months
  • Penalty: Up to £6,000 fine, criminal record

England-specific obligations

4. Electrical Safety (EICR)

  • What: Electrical Installation Condition Report
  • When: Every 5 years or before new tenancy
  • Penalty: Up to £30,000

5. Smoke & CO Alarms

  • What: Smoke alarms on every floor, CO alarms in rooms with combustion appliances
  • When: Tested at start of each tenancy
  • Penalty: Up to £5,000

6. Right to Rent checks

  • What: Verify tenant's right to live in the UK
  • When: Before tenancy starts
  • Penalty: Up to £3,000 per tenant (civil), 5 years imprisonment (criminal)

7. Deposit Protection

  • What: Protect deposit in approved scheme within 30 days
  • When: Within 30 days of receiving the deposit
  • Penalty: 1-3x deposit amount compensation

8. How to Rent Guide

  • What: Provide government's "How to Rent" guide
  • When: Before or at start of tenancy
  • Impact: Cannot serve Section 21 notice without it

9. Selective Licensing (area-specific)

  • What: Property licence from local council
  • When: If property is in a designated licensing area
  • Penalty: Up to £30,000

Wales-specific obligations

10. Rent Smart Wales registration

  • What: Register as a landlord, obtain licence if self-managing
  • When: Before letting
  • Penalty: Fixed penalty or prosecution

11. Renting Homes (Wales) Act

  • What: Issue written occupation contract, meet fitness standards
  • When: Within 14 days of occupation date
  • Penalty: Contract holder can claim compensation

Additional obligations

12. HMO Licence (if applicable)

  • What: Mandatory for 5+ tenants from 2+ households
  • When: Before operating as HMO
  • Penalty: Up to £30,000 and rent repayment orders

13. Furniture & Furnishings Fire Safety

  • What: All provided furniture meets fire safety regulations
  • When: Ongoing — check all provided items
  • Penalty: Up to £5,000 and 6 months imprisonment
